Terms and Conditions of Service for Seez’n

Seez’n, a French SASU company domiciled at 52 Rue de la Tour, 75116 Paris, France (“Seez’n”, “we”, “us”), operates the Seez’n mobile application (“App”) and the website at seezn.io (“Website”) (collectively, the “Service”).

These Terms and Conditions of Service (“Terms”) govern your access to and use of the App, Website, and related services. By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree, you are not authorized to use the Service.

1. Description of the Service

Seez’n is a productivity and wellbeing tool designed to help users reduce autopilot scrolling and build healthier digital habits by linking phone behavior to the “health” of a virtual Tree. Helpful actions within the App can improve Tree health, while usage of selected apps can reduce Tree health and may trigger notifications.

We may update, change, suspend, improve, or discontinue any aspect of the Service at any time, in our sole discretion, with or without notice, to the extent permitted by applicable law.

2. Eligibility

You must have the legal capacity to enter into a binding agreement and to use the Service in compliance with applicable laws in your jurisdiction.

You may not use the Service if doing so is prohibited by applicable law.

3. Registration and Account Security

To use the App, you may need to create an account. We use Firebase Authentication for account registration and login.

You agree to:

  • Provide accurate, current, and complete information as requested.

  • Maintain the confidentiality of your account credentials and not share them with others.

  • Be responsible for all activity that occurs under your account.

  • Notify us promptly of any unauthorized use of your account or security breach.

We may suspend or terminate your account if we believe you have violated these Terms or if necessary to protect the Service, other users, or our rights.

4. App Functionality and User Content
4.1 Tree System, Selected Apps, and App-Usage Events

The Service relies on features that may monitor usage of apps you select (“Selected Apps”) and connect that usage to Tree health. The Service may generate penalties or notifications based on usage patterns.

You understand and agree that:

  • The Tree system is a behavioral and motivational mechanism, not a guarantee of outcomes.

  • You control which apps are “Selected Apps” (where the App provides such controls).

  • The Service may transmit certain app-usage events to our servers to operate the Tree system, maintain history, and enable syncing (as described in the Privacy Policy).

4.2 User Inputs and Content

The App may allow you to submit content such as moods, reflections, triggers, goals, and to-dos (“User Content”).

You are solely responsible for your User Content and agree that you will not submit content that:

  • is unlawful, defamatory, abusive, or harmful,

  • infringes third-party rights (including privacy, copyright, or trademark),

  • contains malware or attempts to exploit or disrupt the Service.

4.3 Wellness / Health Disclaimer

The Service is a self-improvement and habit-building tool. It is not a medical device and does not provide medical, psychological, or health advice, diagnosis, treatment, or monitoring. You should seek professional advice for any health or mental health concerns.

5. Subscriptions and In-App Purchases

Certain features of the Service require a paid subscription (“Seez’n Pro”) and may be gated after onboarding.

5.1 Billing and Automatic Renewal

Subscriptions are processed through the Apple App Store and/or Google Play and may auto-renew unless canceled in accordance with the applicable store’s rules. To manage, cancel, or change your subscription, you must do so through your Apple/Google account settings.

Deleting the App or deleting your account does not automatically cancel your subscription.

5.2 Payment Processing and Subscription Management

Payments are handled by Apple/Google. We use RevenueCat to manage subscription entitlements (e.g., verifying whether you have access to paid features). We do not store full payment card details.

5.3 Prices, Fees, and Taxes

You agree to pay all applicable fees and taxes associated with your subscription, as presented at the time of purchase. Pricing and offerings may change, to the extent permitted by applicable law.

5.4 Refunds

Refunds are governed by the policies of the Apple App Store and Google Play. We do not process refunds directly, but we may provide reasonable assistance if you contact us.

6. Acceptable Use

You are responsible for your use of the Service and must comply with applicable laws. You may not:

  • Use the Service for unlawful purposes.

  • Attempt to reverse engineer, decompile, disassemble, or hack the App.

  • Circumvent access controls, subscription gates, or security measures.

  • Interfere with or disrupt the Service, servers, or networks.

  • Use automated means to access or scrape the Service without our permission.

7. Privacy, Data Protection, and Data Collection

Your privacy is important to us. Our collection and processing of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

In summary, the Service may process:

  • account information (Firebase Authentication),

  • subscription entitlement data (RevenueCat + Apple/Google),

  • user inputs (synced with Firebase),

  • selected apps and app-usage events used to operate the Tree system,

  • notification tokens (Expo Push Notification Service),

  • diagnostics and potentially analytics.

8. Third-Party Services

The Service uses third-party services, including:

  • Google Firebase (authentication and backend storage/sync),

  • RevenueCat (subscription management),

  • Apple App Store / Google Play (payments and subscriptions),

  • Expo Push Notification Service (EPNS) (notification delivery).

We are not responsible for third-party services’ operation, outages, or their terms and privacy practices. Your use of those services may be subject to their own terms and policies.

9. License to the App

Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable, limited license to download and use the App on a device you own or control.

You may not:

  • Copy, modify, distribute, sell, lease, or sublicense the App.

  • Derive or attempt to derive the App’s source code.

  • Reverse engineer, decompile, or disassemble the App except where such restriction is prohibited by law.

For Apple App Store users:

  • These Terms are between you and Seez’n, not Apple.

  • Apple has no obligation to provide maintenance or support for the App.

  • Apple may be a third-party beneficiary of these Terms to the extent required by Apple’s standard terms.

10. Intellectual Property

All Service content and materials (including software, design, text, visuals, and trademarks) are owned by Seez’n or its licensors and are protected by intellectual property laws.

You retain ownership of your User Content. However, you grant Seez’n a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Content solely as necessary to operate and improve the Service (for example, syncing and displaying your content to you, calculating Tree status).

11. No Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or that it will meet your requirements.

Some jurisdictions (including parts of the EU/UK) do not allow certain warranty exclusions, so some of the above may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by law, Seez’n will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including loss of data, profits, or business interruption.

To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid to us (via Apple/Google) for the Service during the 12 months prior to the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Seez’n, its officers, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • your use of the Service,

  • your violation of these Terms,

  • your infringement of third-party rights,

  • your User Content.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if necessary to protect the Service or other users.

You may stop using the Service at any time. You may request account deletion through the App where available (or by contacting us). Account deletion affects stored data as described in the Privacy Policy but does not automatically cancel App Store / Play Store subscriptions.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

15. Consumer Rights (EU/UK)

Nothing in these Terms affects your mandatory statutory rights as a consumer under applicable EU/UK laws.

If you are located in the EU/UK, you may have additional rights relating to digital services and subscriptions under local consumer protection laws.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of France, excluding conflict of law rules.

Subject to mandatory consumer protection rules that may apply in your country of residence, any dispute arising out of or relating to these Terms or the Service will be submitted to the competent courts of Paris, France.

17. Updates to Terms and Privacy Policy

We may update these Terms from time to time to reflect changes in the Service, legal requirements, or other reasons. Updated versions will be posted on seezn.io with an updated “Last Updated” date. For material changes, we may provide additional notice in-app where appropriate.

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the updated Terms.
